SMS / Text Messaging Terms of Service
- If you respond to a text message call to action issued by Maine Public or otherwise voluntarily provide your mobile phone number to Maine Public, you agree to receive text messages (also known as “SMS messages”) from Maine Public at such mobile phone number with updates, donation asks, action opportunities, and other information.
- Text message and data rates may apply for any text messages sent to you from us and to us from you. You are responsible for all such charges and fees. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
- If you respond to a text message call to action (e.g., “Text GIVE to 12345 to donate to Maine Public”), your donation will be charged to your mobile bill or deducted from your prepaid mobile balance.
- Message frequency will vary, and messages may be recurring.
- You can opt out at any time. Just text the word “STOP” in response to any text message received. After this, you will no longer receive text messages from us.
- If you are experiencing issues with any of our text messaging programs, you can reply to any text message with the word “HELP” for more assistance, or you can get help directly by emailing membership@mainepublic.org.
- We may change any short code or telephone number we use to operate our text messaging programs at any time. You acknowledge that any messages, including any “STOP” requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
- You agree to provide us with valid contact information. If you change your mobile phone number, you agree to opt out of our text messaging programs prior to changing your mobile number.
- Data obtained from you in connection with your participation in our text messaging programs includes the information you voluntarily provide to us as well as information we may collect in the normal course of operating our text messaging services, such as your carrier’s name and the date, time and content of your messages. We may share this information with third parties only in the following circumstances: (1) we may share this information with service providers, wireless carriers, and other vendors that assist in the delivery of our text messaging programs as necessary to operate our text messaging programs; and (2) we reserve the right to disclose such information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. However, text messaging opt-in data and consent information will not be shared with any third parties for any purpose.
- You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through our text messaging programs, any errors in such information, and/or any action you may or may not take in reliance on such information or our text messaging programs.
- You release, and agree to indemnify, defend, and hold harmless, Maine Public from and against any claims (and any related losses, liability, costs, and expenses, including reasonable attorneys’ fees) arising from your participation in our text messaging programs, including, without limitation, any privacy or tort claims, claims made under the federal Telephone Consumer Protection Act or any state law equivalent(s), and claims resulting from you providing us with contact information that is not your own or from your failure to notify us of a change in the information you have provided.
- OUR TEXT MESSAGING PROGRAMS ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. YOU EXPRESSLY AGREE THAT YOUR PARTICIPATION IN SUCH PROGRAMS IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, REPRESENTATIONS, CONDITIONS, AND GUARANTEES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, WITH RESPECT TO SUCH PROGRAMS.
- IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR PARTICIPATION IN OUR TEXT MESSAGING PROGRAMS. WITHOUT LIMITING THE FOREGOING, YOU AGREE THAT IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY DAMAGES IN EXCESS OF (IN THE AGGREGATE) FIFTY U.S. DOLLARS ($50.00) BASED ON ANY CAUSES OF ACTION ARISING OUT OF YOUR PARTICIPATION IN OUR TEXT MESSAGING PROGRAMS. THE FOREGOING LIMITATIONS OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
- We may modify or cancel our text messaging programs, or any features of such programs, at any time without notice. We may also modify these SMS / Text Messaging Terms of Service at any time and your continued participation in our text messaging programs following the effective date of any such changes shall constitute your acceptance of such changes.
- These SMS / Text Messaging Terms of Service shall be governed by the laws of the State of Maine, without regard to conflict of laws rules.
